If you are Business Visitor and need to travel to Canada to fulfill an intended duty related to your employment or business prospect there are couple things you need to consider. Depending on the nature of your visit you may qualify as a Business Visitor and obtain your Temporary Resident Visa. Prior to travelling to Canada you have to make sure you meet the requirements as a Business Visitor or else the immigration officer may deny you entry to Canada and ask you to apply for a Work Permit and possibly go through a Labour Market Impact Assessment (LMIA).

As the Business Visitor you cannot enter the Canadian Labour Market which means the immigration officer looks for supporting documents that the applicants’ main source of income comes from outside of Canada. If the foreign applicant gets paid by the Canadian employer then he/she does not meet the definition of a Business Visitor and therefore has to apply for a Work Permit. Some of the intended duties of Business Visitor include attending business meetings, conferences, visiting job sites etc.

You may also qualify as a Business Visitor if you need to send staff members to train Canadian employees on product or equipment purchased from a foreign company as long as they meet the terms and conditions set for the After Sales Service Agreement. For example a Canadian purchased a product from the US that requires maintenance or service. The company in the US can send a representative to fulfill the duties of the After Sales Agreement. The main focus is that the Business Visitor numeration or main source of income is solely provided by the US Company and they are not entering the Canadian Labour Market in any way. Any profits generated by the Business Visitor should only come from outside of Canada. Therefore, as the Business Visitor you must ensure you meet all the requirements to have successful entry at the Port of Entry.
