I have a DUI can I enter Canada?

Being denied entry to Canada can be an extremely frustrating and potentially embarrassing situation. Many people who attempt to cross the border are not even aware that they may be considered inadmissible and are shocked to hear this by a border official

I have a DUI can I enter Canada?

Post by William »

Hello folks.
I have a DUI from 5 years ago and another one from more than 10 years ago.
I am planning a fishing trip to Canada and also need to enter Canada for business purposes.
Would the DUI prevent me from entering Canada?
If yes, what options do I have?

Hello William,
Having a DUI on your record can indeed affect your ability to enter Canada, as Canada takes DUI offenses very seriously. Both DUIs, regardless of how long ago they occurred, can potentially make you inadmissible to enter the country.
Canada's immigration laws consider DUI offenses as serious criminal offenses, and individuals with such offenses on their record may be deemed criminally inadmissible. This means that you may be denied entry into Canada, including for purposes such as business.
However, the length of time since your DUI offenses occurred can impact your admissibility. Typically, if it has been less than five years since the completion of your sentence (including any probation or parole), you may be considered inadmissible. If it has been more than five years but less than ten years since the completion of your sentence, you may still be deemed inadmissible, but you are eligible for rehabilitation. In your case, as your recent offense was 5 years ago, you are eligible for the criminal rehabilitation. This is a permanent document to overcome your inadmissibility.
There are several options available to you:
Temporary Resident Permit (TRP): If your trip to Canada is essential and you are otherwise inadmissible, you can apply for a Temporary Resident Permit.
Criminal Rehabilitation: As it has been min five years since the completion of your sentence for each DUI offense, you are eligible to apply for Criminal Rehabilitation.
At the firm we usually do the Criminal Rehab at the consulate and then send you the client to the border for same day TRP.
Hope this was helpful.
