Are you wondering if you as the employer can use the Express Entry Route to support the application for Permanent Residency in Canada for a Temporary Foreign Worker (TFW) you employ? Yes, but as the Temporary Foreign Worker you need to be in Canada or working under a Positive Labour Market Impact Assessment (LMIA). So the employer can offer the employee a permanent job to back up the application for permanent residency. Once the foreign worker has a valid job offer and supported with the LMIA it allows the worker to get additional points to increase their chances for getting an Invitation to Apply for permanent residency.
In order for the employer to hire the foreign worker permanently he/she has to meet requirements as the employer first before offering the position to the temporary foreign worker for a permanent position. What this means the employer has to go through different recruitment methods to hire a Canadian Citizen or Permanent Resident first prior to offering the position to a foreign worker. Upon receiving a Positive LMIA the employer can hire the foreign worker permanently.
Wondering if as the Express Entry candidate you can start working before getting your temporary resident visa? This depends on whether the candidate is living and working inside of Canada as the Temporary Foreign Worker or not. Generally, candidates are not allowed to work in Canada until they obtain permanent resident visa. If an employer wants a candidate to obtain permanent resident visa he can apply for dual resident labour market impact assessment. What this means the Temporary Foreign Worker is working temporarily until he/she gets a decision on their permanent resident application. The candidates must apply for a Work Permit in this situation and will receive a Temporary Work Permit once he/she has a job offer for the Express Entry application.
