If you have submitted an inland spousal or common-law sponsorship then you are eligible to apply for an Spousal Open Work Permit. The Open Work Permit allows the spouse or common-law partner to work with any employer in Canada meaning it is not job-specific and the employer will not go through a Labour Market Impact Assessment (LMIA). Unfortunately, conjugal sponsorship are not eligible for the Open Work Permit, because the partner lives outside of Canada as these partners cannot get married or be in a common-law relationship due to immigration barriers, sexual orientation or marital status. To be eligible for the Open Work Permit you must be inside of Canada and have submitted an inland sponsorship application.
As long as you qualify under the spousal or common law you can immediately apply for the Spousal Open Work Permit. That means you can include it in your application for spousal or you can submit it to CIC separately under the Open Work Permit. The reason we encourage to apply for Open Work Permit separately, because processing times are faster rather then applying together with your inland application.
If you submit it together with your spousal application you have to wait until you get the Approved in Principle (AIP), once you have that you can apply for the Open Work Permit. Received the Approved in Principle does not mean your application for sponsorship is approved but rather you can apply for open work permit and that stage one is approved.
