For most positions that are being offered to foreign workers, the employer would have to do what’s called the Labour Market Opinion (LMO) now known as Labour Market Impact Assessment (LMIA). What this is, is an application to service Canada demonstrating that the employer is in need of this foreign worker because they were not able to hire a permanent resident or a Canadian citizen. How we do this is by posting to position in three different sites. One has to be job bank Canada and the other two could be whatever is relevant for that particular position either in newspapers, magazine, perhaps there company website etc. The process of such an application can be lengthy so it’s very crucial that we file this application as soon as possible. Current processing times are between 6 to 8 months to receiving this labour market opinion. Once we receive the positive labour market opinion we then file an application for the actual work permit in the country of the applicant citizenship.
For example if we have an applicant who is Indian we would have do the labour market opinion first (6 to 8 months), this is very employer specific again demonstrating that they are in need of this foreign worker once we receive approval from service Canada that this employer is eligible to hire a foreign worker we then go to step two which is the work permit process. The work permit process is essentially demonstrating to service Canada that this individual is the right individual for this position. In addition to this we have to show that the applicant is only coming temporarily to fill this position. So documentation to prove that they will exit the country after their job is finished in Canada (whatever the length may be) is very important. So we have to demonstrate if they have properties that they have to attend to for example, perhaps they have family member back home etc., so again, this application is a two-step process the first is employer specific and the second is employee specific.
