LMIA What is it
The abbreviation “LMIA” is thrown around very often, and you may be wondering what it means or if it applies to you. A LMIA also known as Labour Market Impact Assessment is an application that the employer submits to Service Canada or to HR. This application is intended to show Service Canada that the employer was unable to find a suitable Canadian or Permanent Resident in Canada, and thus was forced to look outside Canada and hire a Foreign Worker. The onus is on the employer to demonstrate that hiring a Foreign Worker was necessary. This is generally done by demonstrating that the job position was posted in at least two different places for a minimum of two weeks. Since that is just the minimum, it is recommended that employers keep their postings up in different places and longer than two weeks to increase the chance of approval. This shows that the employer has put in sufficient effort to hire a Canadian or Permanent Resident before turning to foreign workers. The higher the effort, the stronger the LMIA application. For example, once the posting comes down, proving that you had a limited amount of resumes come in and those resumes were not what you were looking for (due to things such as qualifications or experience) would make for a stronger LMIA application. You would also want to demonstrate that the Foreign Worker has the qualifications you were looking for and is a necessity for your company. Include documents such as reference letters and degrees to make the applicant stand out. Overall, you want to prove to Service Canada that you did everything you could to hire a Canadian but turned to and found a Foreign Worker that was important for your company. Once you have received a positive response on your LMIA application, you will receive a letter. You can give this letter to the Foreign Worker, for him or her to submit to the consulate in his or her home country for a Work Permit.
