A NAFTA Work Permit is a Work Permit issued to Mexican or US citizens to come to Canada. When submitting a NAFTA Work Permit application the employer is exempt from the Labour Market Impact Assessment (LMIA). If you don’t fall under the NAFTA Work Permit Agreement such as NAFTA Professionals, Intra Company Transferees, Traders or Investors then the employer has to submit an LMIA application. What this means is that the employer has to try to hire a Canadian or Permanent Resident first prior to offering the job to a foreign worker. If the employer has attempted different recruitment methods but was successful then Service Canada will issue a Positive LMIA. To get a Positive LMIA the employer has to use different advertising methods and provide supporting documents of their efforts to Citizenship and Immigration Canada (CIC).
It is important to note that just because your citizenship is American or Mexican does not automatically put you under the NAFTA agreement. The occupation offered by your employer has to fall under the NAFTA list of occupations, so if your occupation does not fall under the list then the employer has to go through the LMIA process. There are many other factors to consider as some jobs are completely exempt from the Work Permit such as Business Visitor, employers that have NAFTA Sales Agreement with the Canadian company, emergency care person etc. To determine if you are exempt or require a Work Permit we need to look at the job offer and job description that determines if you need to apply or are possibly exempt from the Work Permit process.
Once you determine whether you are exempt from the Work Permit or need to apply then you can look into the requirements and eligibility criteria depending on the category you fit in.
