There are a number of different categories that a Work Permit can be issued under. Do you have job offer in Canada and not sure under what category you fall under? The different categories of Work Permit include:
NAFTA Agreement
NAFTA lets citizens of Canada, the United States and Mexico gain quick entry into each other’s countries for temporary business or investment reasons. If you fall under NAFTA then you do not an Labour Market Impact Assessment (LMIA). What this means is that the employer does not need to have job offer approved by Service Canada to hire an American or Mexican business person. Also, under NAFTA the business individuals have to follow the rules for temporary entry into Canada, these four groups include business visitors, professionals, intra company transferees and traders and investors.

GATS Agreements
Under GATS, Canada agreed to make it easier for foreign business people to access the Canadian services market. This applies to service providers from more than 140 World Trade Organization member countries. There are three groups of business individuals that are covered under GATS and these include, business visitors, professionals and intra-company transferees.
Open Work Permit
An open work permit is a work permit that is not job-specific, this means the person does not have to go through Labour Market Impact Assessment. These individuals include:
- PR applicants that have applied to an office in canada
- Dependent family members of PR card holders
- Spouses and common-law partners of some workers and international students
- Refugees, refugee claimants, protected persons and their family members
- Some temporary resident permit holders
- Some young workers participating in special programs
Labour Market Impact Assessment (LMIA)
LMIA is for applicants who occupation require an Labour Market Impact Assessment. What this means the employer has to get Positive LMIA before hiring a foreign worker. When Service Canada issues a Positive LMIA it means the employer has put every effort to hiring a Canadian citizen or Permanent Resident prior to hiring the foreign applicant. Once the employer receive Positive LMIA, the foreign worker can apply for a Work Permit in which they need to include the job offer letter, the contract, copy of the LMIA and LMIA number to start the application.

Once that is determined you can see what requirements you need to meet, what the process will be like, how long it takes to obtain the Work Permit and who can accompany you on your Work Permit.
