Work Permit What Constitutes or Exempts Work Video

If you are looking at entering Canada and you want to know if what you are doing actually constitutes work, because if it does then you need a Work Permit. It is important to know what activities constitute work and what activities exempt a work permit.

If you are looking at a regulation, it specifies that the worker class is class of person who becomes a temporary resident, that’s one thing important to understand because if you are coming to Canada and becoming a temporary resident of Canada that is part of the definition that leads towards a work permit.

Now according to the regulation the work is defined as such: is an activity which wage or paid compensation is earned or competes directly with the activity of Canadian citizens or permanent residents in the labour market. What the definition is saying is you are in Canada as a temporary resident and you are being paid for the activities that are being performed in Canada or the activities that you’re asked to do compete with the labour market of Canada and make it more difficult for Canadian citizens or permanent residents to find a job because the foreign worker is doing it without a wage. If your activities in question whether you are being paid or not paid and competes with Canadian citizens and permanent residents of Canada then this means that you are entering the labour market of Canada and you need a work permit before you perform the activities.

How you get a work permit depends on the specific activities, some would first get a Labour Market Impact Assessment, some are exempt from the Labour Market Impact Assessment, or based on an agreement such as the GATS agreement, NAFTA agreement and you can obtain it at port of entry same day processing. How to obtain the work permit will heavily rely on your activities. If you are questioning if your activities require a work permit, there is a couple of questions you can ask yourself and it most likely it will lead you to the right answer: Is this a paid activity in Canada? If I am not getting paid is this activity that a Canadian citizen or a permanent resident could possibly be paid instead of myself. If you answered yes, then you would need to apply for a Work Permit
