Business Visitor Visa Exemptions for Artists

Most people know that if you are considered an artist, you are exempt from applying for the Work Permit in Canada. How do you know if you are under the definition of an artist? The list of Work Permit Exemption can be found on the government website http://www.cic.gc.ca/

If you are one of those individuals that requires a Work Permit then your employer may have to apply for a Labour Market Impact Assessment (LMIA) which can take a couple of months to get decision from the government of Canada, depending on your country of citizenship you may be exempt from the LMIA. A Labour Market Impact Assessment is a document that issued by the Citizenship and Immigration Canada (CIC) to the employer that will either give a positive or negative decision. The purpose of the LMIA is to see if there are any Canadian citizens or Permanent Residents that can fill the position. If no eligible candidate is found than the employer is given a Positive LMIA which allows the applicant to apply for a Work Permit.

As an artist to be eligible to come to Canada without a Work Permit you have to be performing outside of a bar or restaurant environment to be considered an artist. Also, as the artist you cannot get paid by the Canadian organization and you have to provide sufficient supporting documents that when and where your event will take place. If your performance takes place inside a bar or restaurant then you need to apply for the Work Permit. Some examples of individuals that are exempt from the Work Permit include DJ’s performing outside of the bar or restaurant environment, guest artist that are not employed with the Canadian performance group, individuals performing at a private event such as weddings, air show performers and much more.
