Internships are common placements that many students choose to experience. However, this can get confusing for employers if the intern is a foreign national. Many employers wonder whether the intern, who is at their company on a temporary basis for a co-op like placement required by their schools, will need a Work Permit. There are various kinds of activities that are not considered work and therefore are exempt from a Work Permit. These are activities which do not really take away from the opportunities of Canadians or Permanent Residents to gain employment or experience in the work place.
As an employer, if you offer an internship position to a foreign national, you will need to consider whether or not you are taking away this opportunity from Canadian citizens or Permanent Residents, or if you are affecting the possible employment opportunities from Canadian citizens or Permanent Residents. Perhaps if you offer the internship to a Canadian citizen or Permanent Resident, they can gain the experience in your company and use that experience to possibly find employment.
Thus, it is possible that the individual you are offering the internship to would require a Work Permit. It is best to offer it to a Canadian citizen or Permanent Resident, as it is only in very rare cases that interns are exempt from needing a Work Permit. In most cases, they will need a Work Permit in order to be an intern at your company. If you have any further questions, please feel free to call us as we are happy to help.
