Denied Entry to Canada for Criminality or Inadmissibility

A foreign national may be inadmissible for immigration to Canada on the grounds of criminality. These grounds include:

  • For convictions in Canada you have to show that you are convicted in Canada of an indictable offence punishable by a sentence of less than ten years, or you have been convicted in Canada of two more summary offences.
  • For convictions outside of Canada you have been convicted of an offence outside of Canada that if committed in Canada it would be equivalent to an indictable offence punishable by a sentence of less than yen years or if you are convicted outside of Canada of two or more acts that if committed inside of Canada would be equivalent to a summary offence.
  • If you have been convicted outside of Canada of two more acts that if committed in Canada it would be equivalent to a hybrid offence punishable by a sentence of less than ten years.

If you are criminally charged or previously charged with a criminal offence outside of Canada, you may be prohibited from working, studying or applying for permanent residence in Canada.

The following examples of convictions can make you inadmissible to Canada:

  • Driving under the influence
  • Driving with impairment
  • Theft
  • Petty theft
  • Shop lifting
  • Assault
  • Disorderly conduct
  • Obstruction of justice
