Filing for Humanitarian and Compassionate Considerations

Humanitarian and Compassionate (H&C) application is used in special circumstances to ask the government of Canada for permission to stay in Canada based on H&C grounds. One of the most common reasons applicants submit an H&C application is when they don’t meet residency requirements due to being outside of the country for long periods of time. Other reasons you may apply for H&C consideration is when you don’t have enough points under the federal skilled worker program, applicants who cannot be sponsored or persons who fail their immigration medical examinations. So if you don’t meet requirements your application can still have the chance to be approved under H&C grounds.

The H&C application is very similar to the refugee application however the H&C is more about demonstrating how long you have been in Canada, your ties in Canada and what are your H&C factors. The difference between a refugee and an H&C application is that with an H&C application you have to be inside of Canada. One of the strong arguments that you can make with an H&C application is showing that you have established yourself in Canada. So, if you have been in Canada for many years and have had a refusal on an application before but now you have a job, family, property in Canada and going back is not an option for you. With the H&C application you don’t have to demonstrate fear of persecution but rather showing documents on how you have contributed to the Canadian economy, how this would impact your family members especially your children when you are not here or if they are all removed from Canada as well.
