Humanitarian and Compassionate Considerations

Humanitarian and Compassionate Consideration are special considerations that are attached to the application. It is basically asking an officer to bend or even break the rules to allow you to meet certain qualifications. Humanitarian & Compassionate considerations are only considered in very unique circumstances and it’s usually for those who face extreme hardship or have no other options available to them. For example a person comes from overseas on a Work Permit works in Canada for 2 years on a valid Work Permit and is centralized on way of life here. Their Work Permit expires and remains in Canada continuing to work under the table. Once Citizenship and Immigration Canada finds out that you have overstayed your welcome stay you would receive a removal order from Canada. But it is very hard for you to exit Canada as you have stayed in Canada for such a long time and afraid if you got sent back home you would face extreme and undue hardships since you build a life in Canada, built network of friends, have children that were raised in Canada and there is nothing more for them to return back to their home country.

Humanitarian and Compassionate Considerations is not meant to shortcut the immigration system but rather immigration Canada tries to acknowledge all types of situations to help the applicant overcome their situation they are placed in.

Humanitarian and Compassionate Considerations can be considered for those who do not qualify under any other routes but are still considered to have strong ties to Canada. Strong ties to Canada can be family ties, employment ties, property, or financial ties.
