Permanent Resident Card Renewal essentially means that when you become a Permanent Resident, you get a card that’s valid for 5 years. During those 5 years, you have certain responsibilities to Citizenship and Immigration Canada. For example, you should renew it or you must apply for the next step which is citizenship. To renew your PR card, you would have to be inside Canada 730 days out of the 5, which means 2 out of the 5 years you must physically be present in Canada to have a straight forward renewal application.
Sometimes, individuals remain outside of Canada for longer periods of time, because they could not find a job in Canada, family emergencies, studying abroad and many other reasons which made them not meet their residency obligations in Canada. Does that mean they cannot renew their residency? No, what it means is that you can still apply for Permanent Residence Card Renewal with Humanitarian and Compassionate Arguments.
So, what you would have to do is demonstrate to immigration officer why you left Canada and why you still consider Canada your home and when you are planning to come back. Humanitarian and Compassionate arguments is a very subjective topic and it is up to the immigration officer to determine if your reasons are valid for not meeting your residency requirements.
Individuals that do not meet their residency requirements it is highly recommended to consult with an immigration representative, because if you do not provide the correct documentation you could lose your permanent residence. If that happens you have to start from beginning and apply for Permanent Residency all over again.
Also, remember PR card is a card, just like a driver’s license just like a health card, its card it’s issued for you to travel and it does not necessarily mean that your status as permanent residence has expired. You can either apply for Travel Document to enter back into Canada or try to get through the United States or perhaps we can determine other options to get you back inside of Canada, despite your PR card having expired.
