What happens if you are outside Canada and your PR Card expires while you have not yet met the residency requirements? If you would like to maintain your PR card, you may apply with H&C arguments. In this situation, you would be informing the immigration officer that there were H&C reasons why you existed and you would like to come back to Canada. Predominantly, there are three reasons that have a high success rate with such applications.
The first is the PR card holder existed in Canada for employment reasons. This would mean they were either unable to secure employment in Canada, or the employment prospects outside of Canada were fairly better.
The second reason is a family emergency. This is one of the most common reasons, where the individual has to exit Canada to attend to a family member’s health. Many individuals have parents or elderly relatives living outside of Canada with health issues, and temporarily leave to be with them. Once the health issue has been resolved, they come back to Canada.
The third reason is in regards to children involved. If your child is a PR Card holder or a Canadian citizen, you can argue that it is in the best interest of the child to continue his/her stay in Canada for education reasons.
Many clients may ask what their immigration lawyer’s success rate is or what their chances of approval are. It is difficult to disclose that during an initial consultation, since the only way to disclose that is by reviewing documents (which is only done once the firm is retained). The more documents available, the higher chance of success. Some clients do not have many documents due to the reason that they had to exit immediately; but again, you can argue that the need to exit was immediate due to this unforeseen health deterioration of a relative.
The last thing you would want to demonstrate is the economic establishment in Canada. Having secure funds will increase your chances of renewal.
