Humanitarian and Compassionate Consideration is essentially an application for permanent residency for individuals who would otherwise not qualify under any other immigration class in Canada. Additionally, these individuals usually do not have legal status in Canada; however, they also usually have been in Canada for some time. It is important to distinguish between a Humanitarian and Compassionate Consideration and Humanitarian and Compassionate Arguments. You can make Humanitarian and Compassionate arguments with any immigration application if you would like the Immigration officer to consider some personal circumstances when assessing your immigration application. The Humanitarian and Compassionate consideration application is different because it is an application on its own to provide permanent residency to foreign nationals who cannot apply for any other immigration application. Additionally, these individuals often have compelling humanitarian and compassionate grounds to support their H&C application.
