You thought the LMO was difficult well the LMIA application is that much more complicated. When you are applying for Labour Market Impact Assessment (LMIA) the immigration officer looks at six things prior to approving the LMIA application.
The first thing the immigration officer looks at is where you have posted the position. If you have just randomly posted the position for the sake of posting it then you can expect a refusal application. When you post a position post it where potential candidates will be looking for, for example, if you are posting an engineering position it would be a good idea to post at engineering websites, or your own company website.
The second thing the officer looks at is how many positions you were seeking to fill in. Most employers seek in to fill only one position, if you are looking to fill multiple positions you can submit one application but have multiple postings done.
The third thing the officer looks at how many Canadians applied for the position. So let’s say 200 applicants applied but you were not able to locate one Canadian. The immigration officer will need a good reason of why you did not hire one of the 200 applicants. If you don’t have a good reason you can expect a refusal for your application. A lot of times employers make errors in their postings such as not including the skills required for the position or the salary may have too high or too low depending on the position you advertised. When you the posting incorrectly you might get overflow of applicants that do qualify for the position which can cause problems when the immigration officer reviews the application.
The officer also looks at how many applicants the employer has interviewed based on the number of resumes received. As the employer you do not have the obligation to interview every single applicant but have to provide explanation to immigration officer of why the other candidates were not suitable. So if 200 applicants applied and you only interviewed 2 of them you need to provide good reasons of why the other 198 applicants were not interviewed.
Another thing the officer looks at how many Canadians applied for the positions posted and how many you hired. For instance, if you had posted five positions to fill and only four of these positions got filled out of the 200 applicants that applied you got one more position to fill. So you can indicate on your application how many Canadians you hired and were unable to fill all positions because not all candidates qualified.
Finally, you need to clearly indicate why a Canadian was not suitable for the position, you can specify by indicating the qualities the candidate lacked such as their education or skills. The immigration officer either provides a positive or negative decision on the application based on the answers provided.
