With the new LMIA assessment coming into force immigration officers will no longer issue Work Permits longer than a 4 year period. Most Work Permits have a cap of four year maximum, unless your occupation falls under the exemption code. The reason for this change is that four years is sufficient time for the employer to decide either to offer the Foreign Worker permanent full time position to continue with PR application or to hire a Canadian individual for the same position at the organization. So if you have a Foreign Worker in which their Work Permit has reached its 4 year cap you can either hire the foreign worker for the full time position or start training a Canadian candidate so that the organization is not left hanging once the Work Permit expires. If 3 of your 4 year Work Permit has elapsed you can apply for the one year extension. If you decide to apply after the 4 year period you can still get a full extension of the Work Permit.
If you have any further questions regarding the LMIA duration period, please feel free to contact us as we are always happy to help.
