LMIA Exemptions

Not sure if you need to apply for Labour Market Impact Assessment (LMIA) application as an employer? There is LMIA exemption list on the Canadian government website (CIC) that enlists which employers do not have to demonstrate recruitment efforts to Service Canada prior to hiring a foreign worker. Individuals that are exempt from the LMIA include workers that are under the international agreements such Professionals, Traders and Investor, people taking part in exchange programs such as Youth Exchange Programs, Youth Mobility Programs, Teacher Exchange Program and any other exchange programs. Spouses and Common-Law Partners also do not require an LMIA they can apply for Open Work Permit. Open Work Permit is not specific to any employer and therefore you can work for any employer. Also, if you as the main applicant obtained a Study Permit then your spouse or common-law partner do not have to apply for LMIA they can also apply for Open Work Permit through your application. Dependents, Religious Workers, Refugees also do not need to apply for LMIA.
