Bars to Spousal Sponsorship
There are a couple of factors that will prevent you from sponsoring your spouse, common law, or conjugal partner. You are not eligible to sponsor your spouse if you yourself have been sponsored as a spouse or common law partner in the past three years. If three years has passed however, you are eligible for sponsoring your spouse. If you are on social assistance, excluding disability issues, you are not eligible to sponsor your spouse.
Another situation in which you are not eligible for sponsorship would be if you have already sponsored another individual and have not paid the applicable government fees. If you still need to pay your immigration fees, and provide financial family support you will also not be allowed/eligible for sponsorship.
Some other situations that prevent you from sponsorship is if you have declared bankruptcy and the bankruptcy has not been dismissed yet, if you have committed a criminal offence, under rule order, or are detained currently. If you inadmissibility issues are not suspended or pardoned then you have to care of it first prior to sponsoring anyone to Canada.
