Conjugal Application Information

A conjugal relationship is defined as a category for partners of either the opposite or the same sex that are in exceptional circumstances beyond their control that has prevented them from being qualified as common-law partners or spouses. A conjugal relationship is more than just a physical relationship like many would imply. It is a mutually dependant relationship that has the same amount of permanence and commitment as a common-law relationship or a marriage but without the paperwork.

To be eligible as a conjugal partner there are specific conditions you must meet. You must be able to provide evidence that you have maintained a conjugal relationship for at least 1 year, you and your partner have been prevented from getting married or living together because of an immigration barrier, your current marital status (e.g. you are currently married to someone else and living in a country where divorce is not an option), your sexual orientation and many other reasons. An example of an evidence would be showing documents that proof you have been refused for long term stay in each-others countries, providing genuineness documents such as how you guys met, where you met, who proposed etc.

To be an eligible sponsor under the Family Class you need to be 18 years of age or older and either be a Canadian citizens or Permanent Resident of Canada. Another requirement would be signing an Undertaking with the Minister of Citizenship and Immigration Canada what does means you promise to provide financial support for your partner's basic requirements and their dependent children. Some of the basic requirements include food, clothing, utilities, personal requirements, fuel, household supplies, medical bills that is not covered by Canada's health plan such as eye and dental.

The Canadian government allows citizens and permanent residents of Canada to sponsor members of their Family Class, but a large burden follows that responsibility. When you agree to be a Conjugal Sponsor, many responsibilities are instantaneously trusted upon you. That is why you must sign a contract called an undertaking with the Minister of Citizenship and Immigration. The undertaking is a promise you make to provide financial support for your partner’s basic requirements and those of his or her dependent children. When you sign this undertaking document the government of Canada gets reassurance that the applicant will not apply for social assistance. You are financially responsible of your conjugal partner for 3 years since the day you become a Permanent Resident.

If you had sponsored someone in the past and did not meet the requirements then you are not able to sponsor, also if you failed to pay child support or alimony through court order then you also become ineligible to sponsor your Conjugal Partner.
