When applying for the Labour Market Impact Assessment (LMIA) one of the crucial documents is the advertising or posting. In order to ensure that you have posted correctly you have to look at the National Occupation Code (NOC) that is being used which is attached to the job title and job description. As the employer you have to ensure that the NOC or the job that you are offering the applicant also matches the prevailing wage and other criteria such as posting the position in which the Canadian citizen or permanent residents can look at first and see if this is a job that they can apply for.
When doing a posting you are not only looking at the prevailing wage, job description or job duties but also how you can make that position standout in the region you are advertising. The purpose is to advertise the position to Canadian or Permanent Residents first prior to offering the job to a foreign worker. For instance, let say as the employer you are offer a prevailing wage of $20 per hour for the foreign worker to demonstrate you have put effort into hiring a Canadian citizen or Permanent Resident is by increasing the wage. When you increase the wage it demonstrates to the immigration officer that as the employer you have done everything you could do to hire a eligible Canadian for the position but were unsuccessful. So by increasing the wage or posting the position for a little bit longer than 4 weeks demonstrates to Service Canada that you done everything you can to reach out to Canadians.
You have to keep in mind that these statistics that service Canada has on a particular region could potentially be outdated or it might not be completely accurate. For example the position that you are offering may be in a remote area and possibly not updated by statistics Canada. So it will work towards your advantage by keeping the posting up for a bit longer, increasing the salary, posting to additional websites so that you can argue you have done everything to hire a Canadian citizen or permanent resident for the position but were unsuccessful and have no choice but to hire a foreign worker.
