If you are a foreign worker working in Canada with an approved Work Permit you may wonder if your dependent children and spouse can join and if your spouse can apply for the Open Work Permit while accompanying you. In order for your spouse and dependent children to accompany you as the foreign applicant you would have to meet the following conditions. Your Work Permit has to be valid for at least 6 months, meaning it cannot be close to expiry date. If your Work Permit is not valid for 6 months or more you cannot file for an Open Work Permit for your spouse. Another requirement would be the work that you are doing has to meet the minimum skill level that is required. Usually, the minimum requirement is having a diploma, if you are unsure what the requirement is for your Work Permit or your position then you can determine this by seeing if your skills qualify under NOC O, A or B. If your Work Permit was issued under NOC C or D you cannot apply for an Open Work Permit for your wife or partner.

Also, you cannot have any inadmissibility issues inside or outside of Canada. So, if you happen to fall in situation that while on your Work Permit you got convicted of an offense you are not able to apply for an Open Work Permit for your spouse.
