Questions on Appeals

If your immigration application has been refused you may possible appeal it. Appeals are held at the Immigration and Refugee Board (IRB) and an IRB representative will be there with any witnesses and so forth. The appeal decision is made by the member of the Immigration Appeal Division (IAD) and you can bring witnesses, your representative and any additional documents to the hearing that you feel will support your case. Make sure the IAD receives any additional documents 20 days before the hearing, so that they are able to review your documents. When you bring witnesses make sure that is as your additional documents as to who you will be bringing.

What happens during hearing?

• you can testify as to why your application should be approved
• witnesses can then testify supporting your case
• arguments will be made on both sides- why it should be approved on one side and why it should refused by the other side
