Temporary Resident Permit for Persons with Inadmissibility Issue to Canada

Temporary Resident Permit

If you have past inadmissibility issue to Canada due to a criminal, medical or security reasons but have valid reasons to travel to Canada then you may be eligible Temporary Resident Permit (TRP)

Applying for Temporary Resident Permit allows you to travel to Canada on temporary basis as it only takes cares of your inadmissibility on temporary basis.

To obtain a TRP you must have good reasons for entry into Canada. Your need for entry must prove to outweigh the risks upon Canadian citizens. Therefore, when applying for TRP application your reasons must be justified in your application. Some good reasons include travelling to Canada for a business trip such as conferences, meeting with Canadian clients, training or family events such as weddings or funerals.

If you are travelling for a different purpose such as coming to Canada for hiking, fishing or tourism then to have a high success rate depends on what your offence is on record, how many offences you have and when you completed your sentence.

Temporary Resident Permit Holder Condition:

  • Must comply with the conditions set on your Temporary Resident Permit
  • Must not study or work without a proper work or study permit
  • Can remain in Canada based on the validity of the TRP and must exit at the end of the authorized period of stay
  • Cannot re-enter without prior authorization

Temporary Resident Permit Eligibility

To be eligible to apply for Temporary Resident Permit and successful in obtaining one:

  • you must have good reasons for travel
  • having minimum offences on record
  • having completed all sentences that was imposed by the court such as jail time, community service hours, probation, fee payment etc

Duration of a Temporary Resident Permit

A Temporary Resident Permit (TRP) can be granted for 1 day to a maximum of 3 years. The duration is determined by the immigration officer in which they assess

  • your purpose of visit
  • how many offences you have on record- are these reoccurring offences
  • have all sentences been completed

Persons that get granted a longer time frame are individuals with limited offences on record and can proof they need to travel frequently for business or work related trips.

Single Entry TRP vs. Multiple Entry TRP

Single-entry TRP allows you to enter Canada once, and the TRP expires once you exit Canada. The single-entry TRP can be granted for a specific event such as attending a wedding. Multiple-entry TRP on the other hand can be granted for an allocated time span, and allows you to enter and exit until the validity of the TRP. Those who travel frequently to Canada and often on short notice such as flight attendants, pilots or frequent business visitors are more likely to receive a multiple-entry TRP.

After your TRP has expired, your record will once again prevent you from entering Canada. You can then reapply for a TRP, or contact Akrami & Associates to see if you are eligible to apply for Criminal Rehabilitation. Temporary Resident Permit Processing Time

A Temporary Resident Permit can be submitted in two ways, Canadian consulate of Los Angeles or taking your package to the Canadian port of entry and getting same day decision at the border.

Individuals that have urgent travel dates such as business visitors, pilots, family emergency or special events can apply at the Canadian port of entry for same day processing.

Not everyone has a high success rate at the border as many factors plays a role for an officer to consider processing your application at the port of entry. Therefore, if you do not have urgent travel date it is highly recommended to submitting your application to the consulate and waiting the 2-8 months processing times. Sometimes you can face longer processing times based on the volume of applications citizenship and immigration Canada receives.

The processing fee to apply for a TRP is $200 CAD at the Canadian Immigration office or at any Port of Entry.
