Faster Removal of Foreign Criminals Act

On November 21, 2014 our citizenship and immigration officer Chris Alexander announced the new regulations that will come into force called the Faster Removal of Criminals Act. Under this Act there will be further protection for safety and security for Canadians. This Act will will essentially expedite the removal of foreign individuals in Canada who have a criminal conviction on the record.

Essentially the system will safeguard Canadians by:

  • Increasing the penalty from two years to five years period for individuals with inadmissibility issue
  • Five year ban from applying for permanent resident status, meaning if you were found guilty of misrepresentation you would be banned from applying for permanent residence for up to five years
  • Immediate family members are also banned for temporary entry into Canada for those who are inadmissible to Canada on serious grounds. So if you are an applicant who is considered inadmissible essentially having a criminal conviction on your record that is considered of seriousness then your family members such as your spouse and dependent children will also be banned for the same amount of time. For example, if you are not eligible to apply for PR due to your inadmissibility your family members will also become ineligible to apply.

So for those who have a criminal conviction may have a way out by applying for a document called Temporary Resident Permit or Criminal Rehabilitation to overcome this inadmissibility issue either on a temporary or permanent basis.
